1. Eligibility. LYROBOT.COM, (referred to herein as "SPONSOR") IS THE SPONSOR OF THIS GIVEAWAY. THIS GIVEAWAY IS OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES WHO ARE NOT RESIDENTS OF THE STATES OF NORTH DAKOTA, VERMONT, CONNECTICUT, OR MARYLYAND AND WHO: (I) HAVE A LYROBOT.COM ACCOUNT THAT IS IN GOOD STANDING DURING THE GIVEAWAY; (II) HAVE COMPLETED THE ENTRY GUIDELINES (DOES NOT REQUIRE PURCHASE OF ANY KIND TO ENTER) OUTLINED IN THIS SECTION; AND (III) ARE GUILDMASTERS OF WORLD OF WARCRAFT GUILDS THAT HAVE TEN (10) OR MORE MEMBERS ("ENTRANTS"). If you are under the legal age of majority in your country of residence, or your state of residence if you are a resident of the United States (a "Minor"), one of your parents or legal guardians must submit a signed, written statement that they have read, understood and agree to these GIVEAWAY rules with your entry, and that such agreement constitutes acceptance of these GIVEAWAY rules on behalf of you and themselves. If you reside in the States of North Dakota, Vermont, Connecticut or Maryland in the United States, you are not eligible to participate in this GIVEAWAY. To be eligible to win a prize, entries must be completed and received by Sponsor in the format designated below. Directors, officers and employees of Sponsor, its parent, and any of their respective affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies, and immediate families of each are not eligible to win any prizes. All applicable federal, state and local laws and regulations apply. There is no cost to enter or win. Offer void where prohibited. One entry per person. In the event of any dispute, entries will be deemed to have been submitted by the owner of the e-mail address from which the e-mail was sent.
2. Disclaimer. Sponsor, all participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any GIVEAWAY disruptions, injuries, losses or damages caused by events beyond the control of Sponsor; or (d) any printing or typographical errors in any materials associated with the GIVEAWAY.
3. GIVEAWAY Period. The GIVEAWAY shall commence June 15, 2010 at 12:00 AM PST (8:00 AM BST, June 14, 2010) (the "Commencement Date"), and shall continue in duration until 11:59 PM PST June 22, 2010 (7:59 PM BST, June 22, 2010) (the "Deadline"). All entries (opt-in accounts) must be completed by the Deadline to be eligible to win a prize. Winners will be announced before the end of June 25, 2010 11:59 PM PST (7:59 PM BST, June 25, 2010), unless the Sponsor is unable to for any unforeseeable reason as outlined in paragraph 10.
4. Entry in the GIVEAWAY. Beginning on the Commencement Date, you can enter the GIVEAWAY by registering a account (only if the entrant does not currently have an account at LYRobot.com) and selecting the "Opt-in for Giveaways?" option in preferences. You are limited to one (1) entry in the GIVEAWAY. Any entries that are found to be have a duplicate account holder (same person owning multiple accounts), will be disqualified at the sole discretion of Sponsor.
5. Prizes. At the end date of the GIVEAWAY (section 3), five (5) qualified entrants will be chosen as winners of the GIVEAWAY, and will be granted one prize each. Prizes are randomly given and cannot be requested or otherwise predetermined. No substitutions or exchanges (including for cash) of any prizes will be permitted. All prizes are awarded "AS IS." and purchased directly from Blizzard Entertainment, Inc.'s official online store ("http://us.blizzard.com/store/").
6. Judging. Sponsor shall choose the winners AT RANDOM from all entrants who have completed entry guidelines for the GIVEAWAY before the ending date as outlined in Paragraph 3. Winners shall be chosen using RANDOM picking methods by Sponsor at its sole discretion. The decision of Sponsor is final. Prizewinners will be notified by e-mail within seven (7) days thereafter. To claim a prize, winners should follow the instructions contained in their notification. Winners that fail to provide information as requested within the notification will forfeit their prize.
7. Sponsor Use of Entries. All entries in connection with the GIVEAWAY (collectively, "Entry Materials"), along with all copyright, trademark and other proprietary rights associated therewith, become the property of Sponsor upon submission, including the right to use your name, voice, bio, and likeness if requested by Sponsor. You agree to take, at Sponsor's expense, any further action (including, without limitation, execution of affidavits and other documents) reasonably requested by Sponsor to effect, perfect or confirm Sponsor's rights as set forth above in this paragraph 7.
8. Account Ownership and Fair Involvment. You hereby warrant and represent that (a) you have only entered one account into this GIVEAWAY; and (b) your account/use of the services at LYRobot.com abid to the Terms of Service and Privacy Policy agreements.
9. Collection of Information. Winners of this GIVEAWAY are required that you provide your name, e-mail address, and state of residence. By entering the GIVEAWAY, you consent to Sponsor's use of this information to associate your name in promotional materials for the GIVEAWAY in the event that you are chosen to be a winner. As stated above, the GIVEAWAY is not open to anyone under the age of majority in your country of citizenship. In the event that Sponsor becomes aware that you are under the age of majority in your country of citizenship Sponsor will delete, erase or destroy any and all personally identifiable information that is obtained from the entry. In the event that you are a citizen of France and/or any of the other countries whose citizens are eligible for this GIVEAWAY, and pursuant to French law pertaining to data collection and processing, you are informed that the data collector is LYRobot.com, and the data collected will be transferred to the United States of America. Upon request, you will be provided with access to your personal data. You also have a right of opposition to the data collection, under certain circumstances. To exercise such right, you may write to, giveaway@lyrobot.com. You may also withdraw your personal data upon request; however you will be disqualified as an entrant in the GIVEAWAY if you withdraw your personal data prior to the determination and fulfillment of the prizes listed in Section 5 herein.
10. General Release. By entering the giveaway, you release Sponsor, participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the "Released Parties") from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the GIVEAWAY or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory, to the extent permitted by law.
11. Winners list; Rules Request. Winners will be posted on LYRobot.com the day of the giveaway's ending date. You may print this document for your records.
12. Copyright Notice. The GIVEAWAY is sponsored and indorsed by LYRobot.com. All accompanying materials (prizes and marketing media) are copyright © 2010 Blizzard Entertainment, Inc. All rights reserved.
13. Miscellaneous. The GIVEAWAY and these Official Rules will be governed, construed and interpreted under the laws of the United States. Entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all respects. Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend or cancel the GIVEAWAY or any entrant's participation in the GIVEAWAY should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor's control affect the administration, security or proper play of the GIVEAWAY or Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the GIVEAWAY as planned. Entrants who violate these Official Rules, tamper with the operation of the GIVEAWAY or engage in any conduct that is detrimental or unfair to Sponsor, the GIVEAWAY or any other entrant (in each case as determined in Sponsor's sole discretion) are subject to disqualification from entry into the GIVEAWAY. Sponsor reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the GIVEAWAY. In case of dispute, entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet Access Provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Automated entries are prohibited, and any use of such automated devices will cause disqualification.
